LAST WILL and TESTAMENT of 
SETH W. LYON (1799-1868)
(made 9/1867; filed 9/1868 Frontenac County, Ontario Canada)

This is the last will and testament of me Seth Lyon of the Township of Storrington Yeoman.

First I give devise and bequeath to my son Seth Lyon, the younger the northern part of Lots Seventeen, thirty one and thirty two in the Seventh concession of the original Township of Kingston but now in the Township of Storrington aforesaid land described and known as follows.

Commencing at the north west angle(?) Of said Lot number Thirty one thence South along the western limits of said lot twenty four chains and fifty links more or less to a stone monument thence Easterly fifteen chains and seventy links more or less, thence north Easterly five chains and fifty nine links more or less to a stone monument thence Easterly fourteen chains more or less to a cedar post planted at the edge of the Marsh; thence _______________ Easterly five chains nine links to low water mark of Collins Lake, thence northerly along low water mark to the northern limit of said concession and thence Westerly along said northern limits to the place of beginning containing Sixty one acres of land be the same more or less - To have and to hold the same to the said Seth Lyon and his heirs for ever but subject nevertheless to the life interest of his mother as hereinafter reserved.

Second I give devise and bequeath to my son William Lyon the South part of Lot number Thirty tow in the Seventh Concession of the original Township of Kingston but now in Storrington aforesaid and described and known as follows. Commencing where a stone monument has been planted on the limit of said lot and of lot thirty one at the distance of nineteen chains and Sixty Six links from the ____ of said lot thence Easterly fourteen chains nineteen(?) to a cedar post, and thence continuing East on said ____ Six chains more or less to the limit of lots thirty two and thirty three thence Southerly along said limit thirty chains more or less to low water mark of Collins Lake. thence Westerly along said water mark to lot number thirty one, thence northerly along the limits of lots thirty one and thirty two thirty five chains more or less to the place of beginning containing fifty five acres of land. Also part of Lot Number thirty one in the same concession described and known as follows. Commencing at the Western limit of Lot number thirty one at a stone monument twenty four(?) Chains and fifty links more or less ----- the ___ of said lot thence Easterly seven chains and eighty eight links more or less to a stone monument, thence Southerly four chains and seventy five links more or less to a stone monument, thence westerly eleven chains and eighty links more or less to a stone monument, at the west limit of said lot number thirty one, thence northerly five(?) Chains and seventy f___ links more or less to the place of beginning containing five and one half acres together with a right of way fifty feet wide from the north west angle of the first described piece of land to the north east angle of the second described piece of land. To have and to hold the same to the said William Lyon and his heirs for ever but subject never the less to the life interest of his mother as hereinafter reserved.

Third, I give devise and bequeath to my son, Daniel, the South part of Lot number thirty one in the Seventh concession of the original Township of Kingston but now in Storrington aforesaid described and known as follows. Commencing where a stone monument has been planted in the western limit of said lot twenty nine chains and twenty five links from the north west angle thereof thence easterly eleven chains and eighty links more or less to a stone monument, thence ______ thirty four chains and twenty five links more or less to a stone monument thence easterly three chains and eighty two links more or less to a stone monument, thence northeasterly four chains and fifty nine links more or less to a stone monument planted in the limit of said lot and of lot thirty two, thence southerly along said limit fourty chains more or less to low water mark of Collins Lake, thence westerly along said limit or watermark to the west limit of said lot number thirty one and thence northerly twenty chains more or less to the place of beginning containing seventy acres be the same more or less reserving a right of way fifty feet wide in the northern portion thereof from the third to the fourth and fifth _____ _____- the whole of the above described _____ and premises having been surveyed and laid out by Henry(?) W. Nash Esquire Provincial Land Surveyor. To have and to hold, the same to the said Daniel Lyon and his heirs further subject nevertheless to the life interest of his mother as hereinafter reserved.

Fourthly I give devise and bequeath to my wife Catherine Lyon all my goods chattels and Effects and also a life interest in all my lands and tenements.

Fifthly I give and bequeath to my daughter Johanna wife of Cornelius Hushston the sum of one hundred and fifty dollars to be paid whereby my son Seth Lyon in one and two years after the decease of my wife Catherine and I expressly charge the land devised to my said son Seth with the payment of this Legacy.

Sixthly I give and bequeath to my daughter Sarah Jane Lyon wife of L__ Lyon the sum of one hundred and fifty dollars to be paid to her by my son Seth Lyon in one and two years after the demise of my wife Catherine and I expressly charge the land devised to my said son Seth with the payment of this Legacy.

The said several legacies to my daughters I desire may be paid one third in the first year and the remainder in the second year after the decease of my said wife.

Seventhly I give and bequeath to my daughter Elizabeth wife of John Caverly, Rachel Diana Spinster and Catherine Rebecca the wife of Levi Hughston each the sum of two hundred dollars to be paid in manner following - that is to say one hundred dollars to each of my said last named daughters by my son William Lyon to be paid in one two and three years after the death of my wife Catherine and a like sum of one hundred dollars to each of my said last named daughters by my son Daniel Lyon to be paid in one two and three years after the death of my wife Catherine and I do hereby expressly charge the lands severally hereinbefore devised to my said sons Daniel and William with the payment of the Legacies hereby severally devised to be paid by them.

I appoint my friend James Daley and Marshall Campbell both of the Township of Storrington Yeomen as my Executors of this my last will.

In witness whereof I have hereunto set my hand and Seal this nineteenth day of September in the year of our Lord one thousand eight hundred and sixty seven.

The following death notice appeared in the Christian Advocate on 11/4/1868: Seth W. LYONS was born in New York State and came to Canada as a child with his parents and other family members.  He married Catherine Ransier on 11/22/1823.  He died of cancer in Storrington 8/1/1868 in his 69th year, pre-deceased by 3 children who died in infancy or early youth.  Survived by his wife and 8 children.
